§1 Scope of Law

  1. These terms and conditions apply in each, at the time the contract was amended for all business relations between Angels and More and their customers.
  2. These terms and conditions shall apply exclusively. Conflict or deviation from these terms and conditions of the customers will not be recognized unless Angels and More has, in this particular case, expressly authorized it in writing.

§2 Registration

  1. Any goods ordered shall be subject to prior registration as a customer at Angles n’ more. A multiple registration under different names or addresses is prohibited. With the successful completion of the registration process, Angels and More’s customer will be permitted to use the system.
  2. Approval may be revoked by Angels and More at any time and without giving a reason. In this case, Angels and More is authorized to block and cancel the user name and password immediately.

§3 Realization of the Contract

  1. The presentation of Angels and More’s range of goods on computers accesible via the internet is not being used to offer a sales contract with the customer. It is not binding.
  2. By contacting Angels and More via the internet, e-mail, telephone, fax or through other communication channels, the customer is concluding an offer to purchase contract with Angels and More. The customer will then receive confirmation of receipt of the order. This confirmation is not an acceptance of the offer, but only to inform you, the customer, that the order has been received. If necessary, due to possible errors in the information provided about the range on the website, Angles n’ more will point this out and send out a counter-offer.
  3. The contract with Angels and More comes into effect when Angels and More accepts this offer by shipping the ordered goods to the customer.
  4. The acceptance is subject to legal admissibility and the availability of ordered goods or services. If Angels and More can not fill the customer’s order, the customer will be notified of the item’s unavailability. Items temporarily not available for the customer will be noted. The customer’s order will be filled when the product is in stock once again.
  5. Price fluctuations in articles not subject to price maintenance are possible, particularly when a branch store (paragraph 4) is used for collection. The time of submitting the offer in accordance with paragraph 2 clause 1 influences the specified price.

§4 Goods Collected at an Angels and More Boutique

  1. If the customer wishes, as part of the ordering process, to clear goods in an Angels and More boutique, the purchase contract is in effect on collection of the goods by the customer. Angels and More itself is not a partner.
  2. The redemption of online coupons/vouchers, in a pick-up in the Angels and More boutique is not possible.

§5 Delivery & Shipping Costs

  1. Angels and More will deliver the ordered goods to the customer, to the address specified in the order, as soon as possible. Angels and More is at liberty, at any time, to provide partial delivery and partial services, provided that it is agreeable to the customer. If partial deliveries from Angels and More are carried out, Angels and More will cover the additional postage costs.
  2. Delivery will be paid as stated in each individual case.
  3. Delivery within Switzerland is usually within 2-4 working days. When products must be procured from abroad the delivery time may take several weeks. Details of the expected delivery date are subject to change. More detailed information on the non-binding delivery times, especially in deliveries abroad, will be given by customer services.

§6 Property Subject to Rescission of the Contract

  1. Angels and More reserves ownership of the goods until receipt of all payments. The customer must inform Angels and More, immediately and in writing, of all third party access, particularly of enforcement measures and other impairments of his property. The customer must replace all damage and replacement costs caused by a violation of this commitment and necessary intervention measures against third-party requests.
  2. If the customer behaves contrary to contract and particularly if the customer’s payment obligation is not fulfilled, despite reminders from Angels and More after a reasonable period of the previous contract, can withdraw and insist on th release of still owned goods. The withdrawal of the goods or seizure by Angels and More is a rescission of the contract. The resulting shipping costs will be borne by the customer. Angels and More regains full authority of the goods, after receipt.
  3. Angels and More reserves the right, due to a negative result to a credit check, to cancel a contract.

§7 Maturity & Payment

  1. Angels and More will only accept payment methods displayed within the framework of the customer ordering process.
  2. The purchase prices and shipping costs incurred are subject to paragraph 3 of the final invoice.
  3. Angels and More can, without giving reasons, request an advance payment. The order will then be processed after payment is received.
  4. If the customer is in default, Angels and More is entitled to demand collection expenses in the amount of CHF 5, 00. Angels and More’s right to make a higher damage claim, especially with regard to the enforcement of the claim by a debt collection agency or a lawyer, will remain unaffected.
  5. Vouchers/Coupons will only be valid when it fulfils the conditions and is used for the goods groups stated. It is not permitted to sell coupons or coupon codes to trade in any way or purchased from third parties at the time of purchase in crediting them.
  6. When paying with a coupon (voucher) a residual credit is possible. This will be credited to the customer’s account or automatically deducted from the next order.

§8 Revocation

  1. The customer is entitled, without giving any reasons, to withdraw his declaration on intent. This, he may do within 14 days of receipt of the goods in text format (e.g. letter, e-mail, fax) or by returning the goods to Angels and More within that time. The period begins on the date of receipt of the goods by the receiver. The revocation period is sufficient to send the revocation or commodity. The revocation, in text form, is to be sent to the specified address in paragraph 11 or through our contact page (www.angelsandmore.ch/contact_us.html). The customer bears the burden of proof for the dispatch of the goods to be returned.
  2. In the case of an effective revocation, both parties must return services already received. If the customer can only return the product in a deteriorated condition, he must recompense Angels and More to this extent.
  3. The customer must cover the expense and risk of returning the goods delivered, unless these were not those ordered.
  4. Until the goods are returned in full, Angels and More will make use of its lien.
  5. The right is excluded in contracts:
    1. For the supply of quickly perishable goods;
    2. on the supply of goods, which by their nature are not suitable for returning (e.g. e-book, downloads, etc);
    3. on the supply of newspapers, journals, books and magazines;
    4. on the supply of DVDs, CDs, videos, music or cassettes and software, unless they are returned unused, shrink-wrapped or sealed in the original package;
    5. on the supply of goods made to the customer’s specifications (e.g. personal books).
  6. The customer, in the case of a rejection and revocation will bear the costs of the return of the goods to us and the cost of re-sending them.

§9 Duties & VAT

  1. With the import of goods to countries outside of Switzerland, import duties may be incurred. These will be borne by the customer. These vary in different customs territories. The customer is responsible for the proper collection of the necessary duties and fees. Import duties are not shipping costs.
  2. For deliveries within Switzerland, the price contains the current VAT. With exports to other countries, the reported price is the net price without VAT.

§10 Warranty & Liability

  1. Are the goods, at the time of transfer, delivered at risk or inadequate, e.g. Manufacturer’s errors, or a wrong delivery, Angels and More will ensure a replacement. For failure to repair damages, the customer may cancel the purchase. This right expires if the customer does not notify Angels and More within 14 days after receipt of the goods via the contact form (www.angelsandmore.ch/contact.html) , e-mail, telephone, fax or mail.
  2. The liability of Angels and More’s own fault or that of their employees, legal representatives and agents shall be limited to premeditation.

§12 Privacy Policy

  1. In strict compliance with the statutory provisions, business transaction date are necessary and only to be saved in order to process orders, and only forwarded to another company when needed to complete an order. All personal data will be kept confidential. Angels and More is entitled to use the personal data for the purposes of credit assessment and monitoring of credit as part of a data exchange with Angels and More affiliates.

§13 Customer Reviews

  1. If a customer writes a review for goods offered by Angels, n’ more, he/she grants Angels and More the exclusive and unrestricted license for its further use. Angels and More reserves the right to reduce or modify, as well as limit the time of the displayed review. They also reserve the right to reduce or omit information on the author. Customer reviews only give the opinion of the customers and not necessarily agree with Angels and More’s viewpoint.

§14 Final Provisions

  1. Here apply the provisions of the substantive Swiss Law to the exclusion of the Vienna purchase right.
  2. If the customer is a merchant, Winterthur in Switzerland holds the exclusive jurisdiction for all claims in connection with the business relationship. Otherwise, the jurisdiction is determined under Article 22 of The Jurisdiction Act.
  3. Angels and More reserves the right to change the present terms and conditions at any time. The most authoritative version of the GTC can be seen and printed out at www.angelsandmore.ch.
